(c) The Jammu and Kashmir Appropriation Bill authorises payment and appropriation of certain sums from and out of the Consolidated Fund of the Union territory of Jammu and Kashmir for the services of the financial year 2024-25.
3. The Waqf (Amendment) Bill, 2024 has been sent to the Joint Parliamentary Committee for further scrutiny. After introducing the Bill in the Lok Sabha today, Minority Affairs Minister Kiren Rijiju said, the government is ready for further scrutiny of the legislation. Earlier, moving the bill, the Minister clarified that this bill is not intended to interfere in the functioning of the religious body and it is to provide justice to the disadvantaged and poor sections of the Muslim community.
4. The Mussalman Wakf (Repeal) Bill 2024 was also introduced in the House to repeal the Mussalman Waft Act 1923.
5. The opposition parties yesterday staged a walk out from the Rajya Sabha over the issue of disqualification of Indian wrestler Vinesh Phogat from the Paris Olympics. 3. Why Waqf Board Amendment Bill 2024 In News? : Waqf refers to properties dedicated exclusively for religious or charitable purposes under Islamic law.Once designated as Waqf, ownership is transferred from the person making the Waqf (waqif) to Allah, making it irrevocable
(a) In 1954, the Jawaharlal Nehru government passed the Waqf Act, which led to the centralisation of waqfs. Under the Act, the government established the Central Waqf Council in 1964. In 1995, the law was amended to allow the formation of waqf boards in each state and union territory.
(b) What is a Waqf property?
It refers to a moveable or immovable property dedicated in the name of God for charitable purposes by a deed or an instrument.
(c) Waqf is a permanent dedication of movable or immovable properties for religious, pious or charitable purposes as recognized by Muslim Law, given by philanthropists. The grant is known as mushrut-ul-khidmat, while a person making such dedication is known as Wakif.
(d) Who owns Waqf Board?
Waqf refers to properties dedicated exclusively for religious or charitable purposes under Islamic law. Once designated as waqf, ownership is transferred from the person making the waqf (waqif) to Allah, making it irrevocable. These properties are managed by a mutawwali, appointed by the waqif or a competent authority.
(e) Presently there are thirty Waqf Boards across the country in twenty-eight states and Union territories. States such as Goa, Arunachal Pradesh, Mizoram, Nagaland and Sikkim and the Union Territory Daman and Diu have no Waqf Board at present. The Waqf Act 1995 is not applicable to Jammu and Kashmir.
(f) Waqf Boards currently control 8.7 lakh properties spanning 9.4 lakh acres across India , with an estimated value of ₹1.2 lakh crore. Collectively, this makes the Waqf Boards the third largest landowner in India, after the armed forces and the Indian Railways. The Waqf Act was last amended in 2013.
An amended in 2013 to give far-reaching powers to the Waqf Board to designate a property as ‘Waqf Property’. In case of dispute whether a property can be considered a waqf, Section 6 of the 1995 Act reads “the decision of the Tribunal in respect of such matter shall be final.”
(g) PM Modi-led goverment is all set to table the Waqf (Amendment) Bill, 2024, in the Lok Sabha on August 8 . The new bill that proposes to amend the Waqf Act, 1995 will be introduced in the Lok Sabha by Minority Affairs Minister Kiren Rijiju. With over 40 amendments.
(h) The bill aims to restrict the power of Waqf boards to manage its properties and provides for more government regulation.
It also aims to ensure women’s representation on the Central Waqf Council and state boards.
(j) The bill proposes to make registration with the District Collector’s Office mandatory for any Waqf property, so that the property can be evaluated.
(k) Amendments also give the Central government the power to “direct the audit of any waqf at any time by an auditor appointed by the Comptroller and Auditor-General of India, or by any officer designated by the Central Government for that purpose”.
(l) Do waqf boards pay taxes? No, the Wakf board’s income is exempt from Income Tax but revenue generated from leasing of properties can be taxed under the service tax and GST laws.
